Welcome to Crafted by Matt. The terms "we," "us," and "our" refer to Crafted by Matt. We operate this store and website, including all related content, features, tools, products, and services (the "Services"). Our store is powered by Shopify.

These Terms of Service ("Terms"), together with any policies referenced here, describe your rights and responsibilities when using the Services. Please read them carefully — they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Section 1 – Access and Account

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or country of residence, and that you consent to any minor dependents using the Services on devices you own or manage.

To use the Services, you may be asked to provide information such as your email, billing, payment, and shipping details. You represent that all information you provide is accurate, current, and complete, and that you have the right to provide it.

You are responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.

Section 2 – Our Products

We've made every effort to accurately represent our products. However, colors and appearance may vary from how they appear on your screen depending on your device and its settings. Because each item is produced to order, slight variations between units are normal and expected. We do not warrant that the appearance or quality of products will exactly match what's shown online.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product and to limit quantities offered to any person or region on a case-by-case basis.

Section 3 – Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and payment must be received and processed before acceptance. Please review your order carefully — because each item is produced to order, we may be unable to accommodate cancellations after production begins.

If we do not accept, modify, or cancel an order, we'll attempt to contact you using the information provided at checkout.

All purchases are subject to our Refund Policy.

You agree that your purchases are for personal or household use only and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as shown in your confirmation email. Unless stated otherwise, prices do not include taxes, shipping, or any customs/import charges that may apply.

From time to time we may run promotions with separate terms; if those terms conflict with these Terms, the promotion terms will govern.

You agree to provide accurate and current payment information and to update it promptly if it changes. You represent that: (i) the payment information you provide is true and correct; (ii) you are authorized to use the payment method; (iii) charges will be honored by your card issuer; and (iv) you will pay all charges at the posted prices, including shipping and applicable taxes.

Section 5 – Shipping and Delivery

Products are produced and fulfilled through our manufacturing partners and shipped directly to you. All production and delivery times are estimates and are not guaranteed. We are not liable for delays caused by production timelines, shipping carriers, customs processing, weather, or events outside our reasonable control. Section 6 – Intellectual Property

All content on our Services — including trademarks, brand elements, text, images, graphics, video, audio, and their arrangement — is owned by Crafted by Matt or its licensors and is protected by U.S. and international intellectual property laws.

These Terms allow you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Unauthorized use may violate copyright, trademark, and other laws. All rights not expressly granted are reserved.

Crafted by Matt's name, logo, and product names are our trademarks and may not be used without written permission. Shopify's name and logo are trademarks of Shopify. Other trademarks belong to their respective owners.

Section 7 – Optional Tools

We may provide access to third-party tools as part of the Services. These are offered "as is" without warranties or endorsement of any kind. We have no liability for your use of any third-party tool. You should review and accept the relevant third-party's terms before using their tools. New features we add in the future will also be subject to these Terms.

Section 8 – Third-Party Links

The Services may contain links to third-party websites and embedded third-party functionality. We don't control or endorse these, and we're not responsible for their content, accuracy, or practices. If you leave the Services to access third-party sites, you do so at your own risk. Please review the third party's own terms, and direct any complaints to them directly.

Section 9 – Relationship with Shopify

Crafted by Matt is powered by Shopify, which enables us to provide the Services to you. However, all sales are made directly with Crafted by Matt. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss resulting from products or services purchased. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with Crafted by Matt.

Section 10 – Privacy Policy

All personal information we collect is subject to our Privacy Policy, and certain information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you've read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes information about your use of the site. Information you submit may be transmitted to Shopify and other service providers, some of whom may be located outside the United States. Please review our Privacy Policy for details.

Section 11 – Feedback

If you submit ideas, suggestions, reviews, proposals, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display it in any medium for any purpose, including commercial use.

You represent that: (i) you own or have the rights to your Feedback; (ii) you've disclosed any compensation or incentives received for it; and (iii) your Feedback complies with these Terms. We have no obligation to keep Feedback confidential, pay for it, or respond to it.

We may — but don't have to — monitor, edit, or remove Feedback we consider unlawful, offensive, defamatory, obscene, or otherwise objectionable. You agree that your Feedback won't violate anyone's rights, won't contain unlawful or abusive content, and won't contain malware. You're solely responsible for the Feedback you submit.

Section 12 – Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping, transit times, or availability. We reserve the right to correct any errors and to change or update information — or cancel orders — at any time without prior notice, including after an order has been submitted.

Section 13 – Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any laws or regulations; (c) to infringe our intellectual property or that of others; (d) to harass, abuse, defame, or harm anyone; (e) to submit false or misleading information; (f) to upload material that violates these Terms; (g) to send spam or unsolicited promotional material; (h) to impersonate another person or entity; or (i) to engage in conduct that could harm Crafted by Matt, Shopify, or other users.

You also agree not to: (a) upload viruses or malicious code; (b) reproduce, duplicate, or resell any portion of the Services; (c) collect others' personal information; (d) spam, phish, or pretext the Services; (e) use bots, scrapers, automated tools, or AI agents to access the Services; or (f) bypass security measures. We may suspend or terminate your access at any time, without notice, if we believe you've violated these Terms.

Section 14 – Agents

14.1 This section applies if you deploy an "Agent" to access or interact with the Services. An "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct supervision.

14.2 No Agent may access or interact with the Services unless it identifies itself and complies with Section 14.4. Agents must also stop accessing the Services if we request them to.

14.3 We may use technical measures to limit how Agents access or interact with the Services.

14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not conceal that they are Agents (e.g., by mimicking human behavior or bypassing CAPTCHAs); (iii) truthfully answer any question about whether interactions come from a human or computer; and (iv) not circumvent any controls we place on Agent activity.

Section 15 – Termination

We may terminate this agreement or your access to the Services at any time, at our discretion and without notice. You'll remain liable for any amounts owed up to the termination date.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

Section 16 – Disclaimer of Warranties

Information on the Services is provided for general information only. We don't warrant the accuracy, completeness, or usefulness of any information, and any reliance on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY CRAFTED BY MATT, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW SUCH DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

Section 17 – Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CRAFTED BY MATT, OUR PARTNERS, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — AND THOSE OF SHOPIFY — WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Section 18 – Indemnification

You agree to indemnify, defend, and hold harmless Crafted by Matt, Shopify, and our affiliates, officers, employees, agents, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising from (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your use of the Services.

We'll notify you of any indemnifiable claim. Failure to promptly notify won't relieve you of your obligations unless you're materially prejudiced. We may control the defense and settlement of such claims at your expense. You agree to cooperate in the defense.

Section 19 – Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will still be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. The remaining provisions stay in full effect.

Section 20 – Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms is not a waiver of that right. These Terms, along with any policies posted on the site, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements. Ambiguities won't be construed against the drafter.

Section 21 – Assignment

You may not assign or transfer these Terms or any of your rights or obligations without our written consent, and any such attempt is void. We may assign or transfer these Terms at our discretion without notice.

Section 22 – Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. You and Crafted by Matt agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any disputes arising out of or related to these Terms or the Services. Nothing in this section limits any mandatory consumer rights you may have under the laws of your country of residence.

Headings are for convenience only and don't affect the interpretation of these Terms.

Section 24 – Changes to These Terms

You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of these Terms by posting changes to our website. It's your responsibility to check periodically. We'll notify you of material changes as required by law. Continued use of the Services after changes are posted means you accept them.
